Terms and Condition

1. Acceptance of Terms

By booking a tour, using our website, or engaging with ZenYatra’s services, you (“the Traveler,” “you,” or “your”) agree to be bound by these Terms and Conditions. These terms govern your relationship with ZenYatra (“we,” “us,” or “our”), operated by Nitesh Thakur and Dr. Sapna Thakur, Keylong, Lahaul & Spiti, Himachal Pradesh 175132, India.

Please read these terms carefully before completing any booking. If you do not agree to any part of these terms, you must not book or use our services. These terms may be updated periodically; the version in effect at the time of booking will apply to your tour.

2. Booking & Confirmation

2.1 Booking Process

All bookings are made by submitting a booking enquiry (via our contact form, email, or WhatsApp) followed by a booking confirmation form. A booking is confirmed only when:

  • We have confirmed availability for your selected tour and dates
  • You have completed and returned the booking form
  • The required deposit has been received and cleared

2.2 Booking for Groups

When booking on behalf of a group, the lead traveler is responsible for ensuring all group members are aware of and agree to these Terms and Conditions. The lead traveler acts as the primary point of contact and is responsible for communicating information to the rest of the group.

2.3 Accuracy of Information

You are responsible for providing accurate and complete information during the booking process, including health information, dietary requirements, emergency contacts, and passport/ID details. ZenYatra is not liable for any problems arising from inaccurate information provided by the Traveler.

3. Payment Terms

  • Deposit: 30% of the total tour price is required to confirm a booking.
  • Balance: The remaining 70% is due 30 days before the tour departure date.
  • Late bookings: Tours booked within 30 days of departure require full payment at the time of booking.
  • Payment methods: Bank transfer, UPI, Razorpay, Google Pay, or other agreed methods.
  • Currency: All prices are in Indian Rupees (INR) unless otherwise stated.
  • Price validity: Quoted prices are valid for 30 days from the date of quotation. Prices may change due to fuel surcharges, seasonal rates, or other factors beyond our control.

4. Cancellation Policy

4.1 Cancellation by the Traveler

All cancellations must be notified in writing to zenyatra07@gmail.com. The following refund schedule applies from the date we receive your cancellation notice:

  • More than 30 days before departure: Full refund of all payments, minus a ₹500 administrative fee.
  • 15–30 days before departure: 50% refund of total tour price.
  • 7–14 days before departure: 25% refund of total tour price.
  • Less than 7 days before departure: No refund.
  • No-show: No refund. The full amount is forfeited.

You may transfer your booking to another eligible person at no extra charge (subject to any price differences for different dates). Transfers must be requested at least 7 days before departure.

4.2 Cancellation by ZenYatra

We reserve the right to cancel a tour due to:

  • Insufficient group enrollment (minimum group size not met)
  • Extreme weather, natural disasters, or force majeure events
  • Safety concerns that make the tour inadvisable in our judgment
  • Government restrictions, road closures, or permit unavailability

In such cases, we will provide a full refund of all payments received, or the option to transfer to an alternative tour. ZenYatra is not liable for any additional costs incurred (e.g., flights, accommodation) due to tour cancellation.

5. Tour Changes and Alterations

5.1 Changes by ZenYatra

We reserve the right to modify itineraries, accommodations, routes, or activities due to safety, weather, logistical, or force majeure reasons. We will make every effort to provide an equivalent alternative. No refunds are issued for minor changes that do not significantly affect the tour experience.

5.2 Changes Requested by the Traveler

Requests to change tour dates, group size, or other booking details after confirmation may be accommodated subject to availability and an administrative fee of ₹1,000 per change. Changes within 14 days of departure may not be possible.

6. Health, Fitness & Safety

High-altitude Himalayan travel involves inherent risks. By booking, you confirm that you are in good physical health and fitness appropriate for your chosen tour. You agree to:

  • Disclose any medical conditions, medications, or health concerns that may be relevant to your tour at the time of booking
  • Consult a medical professional before undertaking any high-altitude tour
  • Follow all safety instructions given by ZenYatra guides during the tour
  • Not proceed with activities if you feel unwell, especially symptoms of altitude sickness

ZenYatra guides have first-aid training and carry oxygen and basic medical supplies. However, they are not medical professionals. In the event of a medical emergency, you will be evacuated to the nearest appropriate medical facility at your expense (covered by travel insurance).

7. Code of Conduct

ZenYatra is committed to responsible, respectful travel. All Travelers must:

  • Respect local customs, religious sites, and cultural practices
  • Follow “leave no trace” principles — carry out all waste
  • Treat fellow travelers, guides, and local communities with courtesy and respect
  • Not engage in any activities that disrupt or disrespect local communities
  • Follow ZenYatra guide instructions at all times during the tour

ZenYatra reserves the right to remove any Traveler from a tour for inappropriate behavior without refund.

8. Liability & Risk Acknowledgment

You acknowledge that Himalayan travel involves inherent risks including but not limited to:

  • Altitude sickness and other high-altitude health risks
  • Difficult terrain, river crossings, and mountain passes
  • Extreme weather conditions and temperature changes
  • Road conditions in remote mountain areas
  • Limited access to medical facilities in remote areas

ZenYatra, its founders, employees, and partners shall not be liable for any injury, illness, death, loss, damage, expense, or inconvenience resulting from participation in our tours, unless caused by our proven negligence. Our maximum liability to any Traveler shall not exceed the total amount paid for the tour.

9. Travel Insurance

Travel insurance is strongly recommended for all ZenYatra tours, and mandatory for all tours that include high-altitude trekking or Spiti Valley. Your insurance should cover:

  • Medical expenses and hospitalization
  • Emergency evacuation (including helicopter evacuation)
  • Trip cancellation and curtailment
  • Personal accident and loss of baggage

ZenYatra does not provide insurance. You are solely responsible for obtaining appropriate coverage. Proof of insurance may be requested at the time of booking for high-altitude tours.

10. Intellectual Property

All content on the ZenYatra website — including text, photography, logos, graphics, and tour descriptions — is owned by ZenYatra and protected by applicable copyright laws. You may not reproduce, distribute, or use any content without prior written permission.

By sharing photographs or experiences from ZenYatra tours on social media, you grant ZenYatra a non-exclusive, royalty-free license to share your content (with credit) on our platforms. You may revoke this permission by contacting us.

11. Governing Law & Disputes

These Terms and Conditions are governed by the laws of India. Any disputes arising from or related to these terms or your use of ZenYatra services shall be subject to the exclusive jurisdiction of the courts of Himachal Pradesh, India. We encourage resolution of disputes through direct communication first — please contact us before pursuing legal action.
